Attendees will review the rights and obligations of parties in litigation with respect to e-discovery. In addition to discussing the relevant Missouri and Kansas rules of professional conduct and case law concerning these issues, participants will gain knowledge regarding the ABA's recently approved comments to the rule on competency to include technology, predictive coding and keyword searches in e-discovery, technology and practice changes respecting e-discovery, as well as recent decisions from federal and state courts respecting this evolving area of practice.

Rule 4.2 generally proscribes communications between a lawyer and a person the lawyer knows to be represented when the communication involves the subject of the lawyer's representation of his or her client. The Rule's application is often simple and straight-forward. However, circumstances can arise creating uncertainty. Participants will learn what the Rule permits and prohibits and, in particular, how it applies to circumstances involving former employees, constituents of organizations and putative class members.
