  <title><![CDATA[Ethics and Technology Presented by Polsinelli PC]]></title>
  <description><![CDATA[This presentation will address the conflicts of interest that may arise when counsel represent more than one party in litigation or in legal transactions, including the issues that arise when insurers are paying counsel&#39;s fees. In addition to evaluating the relevant Missouri and Kansas&nbsp;rules of professional conduct and case law concerning these issues,&nbsp;there will be&nbsp;discussion regarding&nbsp;the various fact scenarios where these conflicts may arise --&nbsp;including those which are less obvious or unanticipated -- and counsel&#39;s obligation to identify and respond to them when they arise.<br />
<br />
Attendees will review the rights and obligations of parties in litigation with respect to e-discovery. In addition to discussing the&nbsp;relevant Missouri and Kansas rules of professional conduct and case law concerning these issues,&nbsp;participants will gain knowledge&nbsp;regarding&nbsp;the ABA&#39;s&nbsp;recently approved comments to the rule on competency to include technology, predictive coding and keyword searches in e-discovery, technology and practice changes respecting e-discovery, as well as recent decisions from federal and state courts respecting this evolving area of practice.<br />
<br />
Rule 4.2 generally proscribes communications between a lawyer and a person the lawyer knows to be represented when the communication involves the subject of the lawyer&#39;s representation of his or her client. The Rule&#39;s application is often simple and straight-forward. However, circumstances can arise creating uncertainty. Participants will&nbsp;learn what the Rule permits and prohibits and, in particular, how it applies&nbsp;to circumstances&nbsp;involving former employees, constituents of organizations and putative class members.<br />
